Morty's Privacy Policy
This Privacy Policy (this "Privacy Policy") describes the information Morty, Inc. ("Morty," "Company," "we," "us" or "our") collects about you, how we use and share that information, and the privacy choices we offer. This policy applies to information we collect when you register for Morty’s mortgage broker services, access or use our website, mobile applications, products, and services (collectively, the "Services"), or when you otherwise interact with us. As used in this Privacy Policy, the term "Site" includes: all websites and all devices or applications operated by Morty that collect Personal Information (as defined below) from you and that link to this Privacy Policy; pages within each such website, device, or application, any equivalent, mirror, replacement, substitute, or backup website, device, or application.
By using our Site, you are consenting to the use of information and agreeing to these guidelines and the other Morty policies described on our Site.
Because of the financial nature of our business, our Sites are not designed to appeal to people under the age of 18. Therefore, we don’t knowingly attempt to solicit or receive any information from children.
Morty Consumer Privacy Principles.
Your privacy is critically important to us. At Morty we have some fundamental principles on consumer privacy that we have adopted an integral part of our Company values:
- We tell you how and why we use the information you provide to us.
- We give you choices about how the personally identifiable information ("Personal Information") that you provide to us may be used.
- We provide you the opportunity to update or correct your Personal Information.
- We work to protect Personal Information from loss, misuse, or unauthorized alteration.
- We provide various ways for you to contact us about our information practices and other aspects of privacy.
We tell you how and why we use the information you provide to us.
To maximize the value of our services, we may request information from you when you visit our Sites. Morty may collect Personal Information about you, including but not limited to the following:
Registration Information: When you register for an account on the Site, you provide your email address and choose a password. You use your email address and password to gain access to your pre-approval and loan application information, financial information and/or customized rates. We use your contact information to provide you with messages, alerts and updates regarding your loan status, which is part of the Morty service. You will be able to update and modify the information you have entered on the Site until you progress to the Lock and Close section of the Site.
Identification Information: You may also be asked to provide identification information to confirm your identity, including, without limitation, your first and last name and certain financial information.
Credit Report: By submitting a loan application or a request to be pre-qualified to us, you authorize us to share your credit report with our affiliates and partners only to process your pre-qualification or loan application. Credit reporting agencies may share your information with other companies when you apply for a home loan. This may cause you to receive email messages or phone calls that you didn’t ask for, offering credit cards, refinancing or other loan products. Application Information: You may also be asked to provide additional information that will be provided to third-party sources of funding in connection with your applications for funding from those third-party sources, including certain financial information and other documents required by the third-party source of funding to complete an application.
Third-Party Sites: You may also enter in certain passwords, usernames, account numbers, and other account information for third-party sites and Internet services ("Third-Party Sites"). In order to display information to you or to fulfill your requests for certain products and services through a Service, we may collect, on your behalf, your account and other Personal Information from Third-Party Sites that you register under your account via the Service. We may also collect information about you from credit bureaus, mailing list providers, publicly available sources, and other third parties. Morty uses third parties to gather your data from financial institutions. By using our Service, you grant our third-party provider the right, power, and authority to act on your behalf to access and transmit your Personal Information and financial information from the relevant financial institution according to terms of our third-party providers’ privacy policies.
Service Providers: We may also supply the Personal Information you provide, on a confidential basis, to service providers, such as wholesale lenders, title companies, appraisers, credit reporting services, etc., who assist us in qualifying, processing, closing and servicing your loan. For example, we may use service providers to enhance our Site technology, deliver products, or to send emails. When we employ service providers, we may need to share your Personal Information. Service providers are strictly prohibited from using your Personal Information for purposes other than to act on our behalf.
Morty uses Plaid Technologies, Inc. ("Plaid") to gather your data from financial institutions. By using our Service, you grant Morty and Plaid the right, power, and authority to act on your behalf to access and transmit your Personal Information and financial information from the relevant financial institution. You agree to your Personal Information and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy, found here: https://plaid.com/legal/#Privacy-Policy
Referral Partners: We may also collect application information, including Personal Information, about you from our third-party referral partners.
Information Collected by Cookies and Web Beacons: We use various technologies to collect information, and this may include sending cookies to your computer or mobile device. Cookies are small data files that are stored on your hard drive or in device memory by a website. Among other things, cookies support the integrity of our registration process, retain your preferences and account settings, and help evaluate and compile aggregated statistics about user activity. Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Services and after you leave our Services. Technical and Navigational Information: We may collect your computer browser type, Internet protocol address, pages visited, and average time spent on our Site. This information may be used, for example, to alert you to software compatibility issues, or it may be analyzed to improve our web design and functionality.
Mandatory and Optional Information: We identify what information is required to fulfill your request. If you chose not to provide mandatory information, we will not be able to provide you the Service you are requesting. As part of your use of our Site, we may collect information that my include your name, address, social security number, the location and value of the property related to the requested loan products or services, financial information about your assets and income, financial accounts, insurance and other information. As part of this process, you consent to Morty obtaining a credit report and for us to use that information as described in this policy. We will also collect information about your activity on the Sites and use that information as described in this policy.
Information that’s been de-identified: Except as otherwise provided in this Privacy Policy, we may de-identify your Personal Information so that you are not identified as an individual, and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or de-identified information to a partner (or allow a partner to collect such information) in a manner that would identify you as an individual person.
Service Alerts and Critical Notices: Although we respect and honor the privacy preferences you have expressed, we may need to contact you to inform you of specific changes that may impact your ability to use this Service or for other critical non-marketing purposes, such as bug alerts. We may also contact you to respond to your specific requests, to clarify the order information you provided to us, or to notify you of upcoming subscription expiration dates.
Change of Control: Your Personal Information may be transferred in connection with a sale, merger, transfer, exchange or other disposition of all or a portion of a business of Morty.
Changes to Our Privacy Policy: If we plan to make significant changes to any of our privacy policies or practices with respect to how we use Personal Information, we will post those changes to the Site.
Legal Disclosures: In some cases we may disclose certain information to comply with a legal process, such as a court order, subpoena, search warrant, or law enforcement request.
We give you choices about how the personal information that you provide to us may be used.
We give you the opportunity to control the use of your Personal Information for purposes other than to fulfill your request or as is required to process, close and subsequently service your loan. For example, on occasion we may use your contact information to send you promotional communications about Morty products. If you do not wish to receive such communications, you may specify your contact preferences during the information collection process or you may send an email to help@morty.com.

We work to protect personal information from loss, misuse, or unauthorized alteration.
We employ industry recognized security safeguards to help protect the Personal Information that you have provided to us from loss, misuse, or unauthorized alteration. All data sent to Morty is protected with technology that enables encryption of your data. We use:
- Secure Socket Layer (SSL): The Morty Web server supports the Secure Socket Layer (SSL) transaction protocol originally developed by Netscape and now largely accepted as an industry standard. The purpose of this encryption protocol is to keep confidential the information passed back and forth between a Web server and its users.
- 128-Bit Domestic Grade Strong Encryption: Morty uses 128-Bit Domestic Grade Strong Encryption, a powerful encryption commercially available for Internet products. (However, be aware that if you are using a 40-bit browser, your encryption level, while secure, is not the highest level available.) United States citizens can download free 128-bit browsers from Mozilla, Apple, or Microsoft. We work to protect Personal Information stored on the site’s servers from unauthorized access using industry standard computer security products, such as firewalls, as well as carefully developed security procedures and practices. All employees must review and sign a written statement of these practices which include limiting access to sensitive information to only those employees who require the information and enforcing strict password protocols for all employees. In addition, a username, member ID name and password are required for you to use, view or change application or interview information. We use both internal and external resources to review the adequacy of our security measures on a regular basis.
